Last minute developments related to short-time working allowance occurred. Family, Labor and Social Services Minister Zehra Zümrüt Selçuk announced that applications regarding short-time working allowance will start tomorrow (23 March). So what is a short-time working allowance, how are short-time working applications made?

WHAT IS SHORT WORKING PAY?

In the event that the weekly working hours in the workplace are temporarily reduced by at least a third or at least four weeks in the workplace without any continuity condition due to general economic, sectoral, regional crisis or challenging reasons, the President decides not to exceed three months in the workplace (President’s decision It can be extended up to 6 months.) It is an application that provides income support to the insured for the period they cannot work.

HOW TO APPLY?

Stating that the announcement regarding the applications will be published on the address www.iskur.gov.tr, Minister Selçuk said, “The commissioning of the Short Work Allowance was included in the‘ Economic Stability Shield Package announced by our President. Our İŞKUR board of directors has also taken a decision to make applications to speed up the process. Short work payments will be made after the eligibility determination to be made by our Directorate of Guidance and Inspection. ”

TO IMPLEMENT A SHORT WORK AT THE WORKPLACE;

The employer; It is necessary to apply to İŞKUR that the working time in the workplace has decreased or stopped due to general economic, sectoral, regional crisis or challenging reasons, and it has to be determined that the workplace has been affected by this situation as a result of the compliance determination made by the Labor Inspectors.

FOR THE WORKER’S BENEFIT FROM SHORT WORKING PAY;

The employer’s short work request is found to be appropriate as a result of the examination by the labor inspectors,

It is necessary to find the information of the worker in the list of those who will participate in the short study as a result of the examination by the labor inspectors.

SHORT WORKING REQUEST AND EVALUATION OF THE REQUEST

Employers can apply for a short work by arranging the Short Work Request Form and information on the workers to be short worked due to general economic, sectoral, regional crisis or compelling reasons.

Short work applications are made by employers on behalf of workers. Workers cannot request short work.

If the existence of compelling reasons arising from the periodic situations arising from the general economic, sectoral or regional crisis and external influences is claimed by the confederations of workers and employers’ unions or if there is a strong sign in this direction, the issue is evaluated by the Board of Directors of İŞKUR. The Board of Directors’ Decision is not required for applications made on grounds of earthquake, fire, flood, landslide, epidemic disease, mobilization for other compelling reasons.

If there is no decision taken by the Board of Directors regarding the compelling reasons arising from the periodic situations arising from the general economic, sectoral or regional crisis and external effects, the applications made by the employers are rejected by the Institution unit.

After completing the determination of conformity as a result of the examination by the labor inspectors, the employer’s requests for changing the list of workers to be short-worked and / or increasing the short working time applied at the workplace are evaluated as new applications.

New Type Coronal Virus (Covid-19) Effective Short Work Request and Evaluation

A short study has been initiated within the scope of the “compelling reason arising from the external conditions due to external influences”, taking into account the possible effects of the new type of coronavirus (Covid-19), which emerged in the Wuhan city of the People’s Republic of China, showing its effect in many countries.

The employer who requested short work on the grounds that he was adversely affected by coronavirus; With the proof of this, the Short Work Request Form can apply to the short work by sending an e-mail to the e-mail address of the İŞKUR unit to which the list containing the information about the workers to be short-worked.

It is important to add the documents that constitute the basis for the negative impact of the coronavirus in order to complete the applications quickly without going to the workplace through the document. If necessary, additional documents can be requested by contacting the employer. The employers will be informed as soon as possible, and the applications will be sent to the Directorate of Guidance and Inspection for the purpose of determination of compliance.

GENERAL INFORMATION FOR CONFORMITY DETERMINATION

In accordance with the decisions taken by the Ministry’s Guidance and Inspection Department, the following issues will be taken into consideration in the eligibility assessment examinations to be carried out by the Ministry of Labor Inspectors according to the Covid-19 Decision made by the Board of Directors of our Institution;

All examinations will be carried out in the Guidance and Inspection Department or Group Presidencies without going to the location, only through the relevant application documents and annexes and without preparing the determination report.

If it is evaluated that there is a deficiency in the application documents during the review process, the employers will be contacted immediately, and the missing documents will be requested to be transferred electronically and the examination will be completed urgently on the basis of documents.

Documentation on whether the workplaces are only in this scope will be sufficient in the compliance assessment examinations made for the workplaces that have been suspended by the Presidency, Ministries or related public institutions and organizations.

The relevant documents that will reveal the situation will be sufficient for the determination of conformity assessments made with regard to the workplaces that have been suspended or reduced within the framework of the administrative decisions of the employers.

A report in writing will be prepared by the Ministry of Labor Inspectors regarding the determination of conformity. The aforementioned articles and their attachments will be sent to the Provincial Directorates of our Institution electronically via the address of Kep, and their wet signature will be sent later to be kept in the file of the workplaces.

It should be noted that the eligibility determination process related to the workplaces, whose activity has been suspended by the Presidency, Ministries or relevant public institutions and organizations, is limited to the duration of the administrative savings, and the short-term implementation of the administrative savings will also end spontaneously. .

Notification of the Result of Short Employment Request to the Employer

İŞKUR is notified to the employer as a result of the conformity determination made by the Labor Inspectors, due to the general economic, sectoral, regional crisis or compelling reasons, the working time in the workplace has decreased or stopped significantly. The employer also declares the situation in a place that workers can see at the workplace and informs the trade union, if any, to the collective bargaining agreement. In cases where announcements are not made to the workers through announcements, workers who are subject to short work are notified in writing. The employer, whose request for short work is approved, sends the Short Work Notification List by updating it within the period notified by the Authority.

Employers who request short work on the grounds that they are adversely affected by the coronavirus are made to the address they send their requests to via e-mail. The employers, whose request is approved, update the Short Work Notification List within the period notified by the Authority and send it to the e-mail address of the İŞKUR unit they apply for.
