Turkey : İBB President İmamoğlu brought those decisions to court!

During the October and November sessions of the IMM Assembly in 2019, 3 controversial decisions were taken with the proposal of the AKP group.

With the decision of 2 separate councils, it is located in Şişli, Güngören, Sultangazi, Sultanbeyli, Gaziosmanpaşa, Eyüpsultan, Bağcılar, Esenler, Kağıthane, Başakşehir and Beşiktaş, which are located in the area of ​​83 acres of Levent IETT, where the Sheikh Sheikh wanted to build a skyscraper. The green area and the park were declared by changing the zoning with the AKP group’s proposal in a way that was 295 thousand square meters of land.

With the decision of the other council, some parcels were allocated free of charge to AKP district municipalities by jet speed.

İMAMOĞLU LAUNCHES FOR CANCELLATION OF 3 DECISIONS

The decisions were vetoed by İBB President Ekrem İmamoğlu. The IMM Assembly, where the AKP is the majority, resisted the veto decision of İmamoğlu in January sessions and passed the decisions exactly.

Imamoglu filed a lawsuit with the request of the cancellation and suspension of the execution of 3 decisions taken at the IMM Assembly by using his authority from the law.

In the lawsuits filed on January 24, 2020 for cancellation of an allocation-lease transaction with 2 different zoning plan amendments, İmamoğlu was a “plaintiff” and the Istanbul Metropolitan Municipality was a “defendant”. The Istanbul 3rd Administrative Court will take the case.

WHAT HAPPENED?

The parliamentary rulings were taken during the IMM Assembly’s session held in October and November 2019.

İBB President Ekrem İmamoğlu vetoed the decisions and sent them to the relevant commissions for discussion.

Vetos were put on the agenda in the first parliamentary session of 2020. The commissions brought the same reports back to the agenda of the IMM Assembly on January 16, 2020 without insisting on their decisions and changing their views.

The dissenting opinion of the CHP group fell on the reports submitted in 3 different articles. The annotation; It was emphasized that the city council could not decide on the sale or allocation of a municipal real estate without the demands of the relevant units, replacing the mayor.

It was noted that a decision in this direction means the wrath of authority.

It was pointed out that it is not appropriate to make a plan change with the proposal and that it will not become a zoning plan as there is no opinion from the relevant institutions and organizations.

It was stated that the decision in this direction was unlawful.

Speaking at the session, Beylikdüzü Mayor Mehmet Murat Çalık issued the financial balance of these decisions.

Çalık drew attention to the fact that İBB was losing 5 billion TL in value with these decisions and said, “You would gain 2 thousand kindergartens in Istanbul with this number.”

After the discussions, all three reports were accepted in the parliament as “mostly mostly insistent decision”.
